General terms and conditions of sale

1. Scope of application

1.1. These general terms and conditions of sale (hereinafter referred to as the "General Terms and Conditions") apply to the purchase of furniture offered by iWood SA (hereinafter referred to as "iWood") on the iwood.care website (hereinafter referred to as the "Website") and to the use of the Website.

1.3. iWood reserves the right to amend these Terms and Conditions. The version in effect at the time of the conclusion of the sales contract shall be decisive.

2. Conclusion of the contract

2.1. On the website, the buyer chooses a piece of furniture from the catalog, or configures the furniture himself, i.e. chooses the dimensions of the furniture, the type of wood, and its treatment. Then, the buyer chooses the carpenter among those available on the website. Finally, the buyer chooses between the different removal and assembly options.

2.2. At the end of the configuration process on the website, the purchase module displays a price including VAT corresponding to the customer's choices. This is an order with a payment obligation. Once the payment is made, iWood confirms receipt of the order by sending an email including all information concerning the furniture configured by the buyer, the price, including the production time.

2.3. If the customer chooses the "custom" option, iWood will send a document within 3 days of the order including the production plans, with the dimensions and type of wood chosen.

2.4. If the customer has chosen the option of home delivery and/or assembly, iWood will liaise between the customer and the producer so that they can agree on a date together.

2.5. In any case, the conclusion of a contract shall only come into being with the sending of a confirmation e-mail by iWood.

3. Awards

3.1. The prices of furniture, delivery and taxes are indicated for each piece of furniture in the sales portal.

3.2. The above-mentioned prices shall also be indicated transparently and in detail on each order confirmation.

3.3. The invoice details in a transparent manner the distribution of all costs of the purchased furniture.

4. Terms of payment and payment methods

4.1. Payments made on our sales platform are secured by the company Stripe. Stripe charges a commission of 2.9% + Fr.0.30. This amount is included in the offer of the configurator and is mentioned on the invoice.The Stripe Terms and Conditions can be found at the following URL:

5. Verification of products, complaints

5.1. At the time of pick-up or delivery, the buyer is required to verify with the carpenter that the furniture is complete and undamaged according to iWood's reception protocol. After control and validation, the carpenter will make him sign a delivery note.

6. Warranty and liability

6.1. The warranty claim shall expire two years after the removal or acceptance of the furniture.

6.2. iWood shall not be liable for any defects that the Buyer has discovered or could have discovered upon collection or receipt of the furniture and that the Buyer did not report immediately upon discovery and within the warranty period.

6.3. iWood shall not be liable for any damage caused by use, aging or improper use or handling of the furniture.

6.4. The furniture is manufactured by the carpenter according to the file and plans prepared by iWood based on the information configured by the buyer. The only material used is wood. Wood is a natural raw material that has different marks and shades of color that make it unique. Differences in structure and color are inseparable from the nature of the product itself. Wood reacts to the hydrometry of the place, deformations can be noticed in a too dry or too wet environment. The ideal humidity level is between 40% and 60%. Outside these values, deformations are inevitable. In view of the above, minor deviations in size, color, wood structure and finish do not constitute a defect and are not grounds for complaint.

6.5. In the event of a defect in the furniture attributable to iWood, iWood reserves the right to replace the defective furniture or part. If iWood decides to replace the defective furniture or part, the Buyer shall not be entitled to rescind the sales contract, reduce the purchase price or claim damages. The furniture or replacement parts shall be provided by the carpenter who manufactured the furniture.

6.6. The collection or delivery period shall be agreed between the buyer and iWood and shall be stated in the order confirmation. If the furniture cannot be delivered within the agreed upon period, the buyer shall be informed accordingly. Delays in readiness for collection or delivery do not entitle the buyer to withdraw from the contract of sale, to demand reimbursement of the purchase price or to assert a claim for compensation.

6.7. In the event that iWood is unable to supply the ordered furniture through no fault of its own, because the carpenter does not fulfill his contractual obligations, iWood shall be released from its performance obligation and shall be entitled to withdraw from the sales contract. In this case, iWood shall inform the buyer of the non-availability and, in case of withdrawal from the contract, iWood shall refund the buyer the purchase price by the same method of payment used at the time of the conclusion of the sales contract.

6.8. The presentation of the furniture on the website is not binding. iWood reserves the right to change the furniture offer, its presentation or to remove certain furniture from its offer completely. iWood declines all responsibility for errors, incorrect presentations or omissions in the catalog available on the website.

6.9. Subject to the mandatory provisions of the law, in particular the Federal Product Liability Act, iWood shall not be liable for any damage not related to the furniture itself, in particular for indirect or consequential damages, loss of profit or any other pecuniary loss suffered by the buyer.

7. Right of return

7.1. Since the furniture offered by iWood is customized and made to order, the buyer does not have the right to return the ordered furniture.

8. Data protection

8.1. The processing of the buyer's personal data by iWood is necessary in particular for the proper functioning of the website and to provide the service related to the sale of furniture by iWood.

8.2. Further and more detailed information on the processing of personal data by iWood in connection with the use of the website is available in the Privacy Policy available here. This Privacy Policy is an integral part of these Terms and Conditions.

9. Intellectual property rights

9.1. The website and all content contained therein (including, without limitation, software, files, design, graphics, images, photographs, audio and video content and data) and the general appearance and design of the website, including, without limitation, all copyrights (including software rights), trademarks, patent rights and other intellectual property rights, are and remain the property of iWood or iWood has the corresponding rights of use. Any unauthorized use of this website or its contents is prohibited without the express prior written permission of iWood.

10. Applicable law

10.1. Swiss law shall apply. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded. For natural persons, the place of jurisdiction shall be the place of residence or the place of business of iWood. For legal entities, the place of jurisdiction shall be the place of iWood's registered office.
